Much is happening on the Medicare front these days. From changes to the False Claims Act to proposed modifications to the Medicare physician fee schedule (MPFS) and the hospital outpatient prospective payment system (HOPPS), just about every health care provider is affected in some way.
On July 1, the Centers for Medicare and Medicaid Services (CMS) announced its proposed changes to the MPFS for 2010, including a significant decrease in the conversion factor used to determine Medicare payment, a clarification of its policy on physician signatures on requisitions for clinical laboratory tests, deletion of codes for physician consultation, modifications to payment for diagnostic imaging services, new accreditation standards for imaging, and minor clarifications to the “stand in the shoes” concept under the Stark physician self-referral rules.
That same day, CMS also released its proposed HOPPS changes, including further revisions to its policies on physician supervision of outpatient services. In addition, legislation recently signed into law—the Fraud Enforcement and Recovery Act—significantly amends the Federal False Claims Act (FCA) and expands the potential liability for all companies doing business with the government.
