The Centers for Medicare & Medicaid Services (CMS) far-reaching Stark changes, which took effect in early December, reflect frustrations with what the agency sees as a growing number of arrangements that permit physicians to profit from referrals of ancillary services, while working around Stark restrictions.
In short, the changes are aimed at "loopholes" in the rules, including "per click leases," percentage compensation, markup of purchased diagnostic tests and interpretations, professional courtesy, and much more. In addition, CMS has included an anti-markup provision in the 2008 physician fee schedule rule, which takes effect January 1. These changes will have a major impact on how pathologists, radiologists, and labs conduct their business.
